The new punishment for those convicted of a second or third drunk-driving offense is the installation of an ignition interlock device [link to 5.0]. This device requires the driver to blow into a breath analyzer in order to start the car. Ignition is deactivated if the driver's BAC (Blood Alcohol Content) is .05 or higher. The device remains on the car 6 months for a first offensive of .02 or higher, 1 year for second offenders and 2 years for a third. The device is installed at the driver's expense.
The punishment for third-time offenders has been increased to a third-degree felony if there has been a prior conviction within the last 10 years. This involves up to 5 years in prison and a $1,000-$5,000 fine.
